WHEREAS, the City of Plymouth and Marvin H. Anderson Construction Company have entered into a development contract dated May 29, 1981 for the development of Zachary Hills 2nd Addition; and WHEREAS, as part of this development, the developer was required to construct a 16 inch watermain in Zachary Hills 2nd Addition in order to conform with the City of Plymouth's Water Distribution Plan; and WFiSRBAS, in accordance with City policy the developer installed the required 16 inch watermain in Zachary Hills 2nd Addition in 50th Avenue North and Balsam Lane North to 50th Place North; and WHEREAS, the City of Plymouth has previously accepted the utilities, including the 16 inch watenmain, for continual maintenance in 1986; and WHEREAS, it is the policy of the City of Plymouth to reimburse developers for required watermain construction upon completion in accordance with the approved plans and specifications and acceptance for continual maintenance by the City; and WHEREAS, this amounts to $11,100.00, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNBSOTA; That the developer, Marvin H. Anderson Constriction Company is to be reimbursed in the amount of $11,100.00 for the required 16 inch watermain constriction based on the alignment in the constriction plans and in accordance with City policy. BE IT FURTHER RESOLVED that the funds be allocated from the Trunk Water Fund. Adopted by the City Council on January 17, 1995.
