WHEREAS, the City Council approved a Preliminary Plan/Plat for Holly Creek by
City Council Resolution 92-84; and,
WHEREAS, the Resolution 92-84 provided for compliance with Resolution 89-439
regarding a Tree Preservation Plan; and,
WHEREAS, the developer provided a financial guarantee in the amount of $9,070 to
secure execution of the Tree Preservation Plan; and,
WHEREAS, the City Forester in a letter dated October 28, 1994 has certified the
development and has declared a fine of $3,100 for noncompliance with the Tree
Pfeservation Plan, and he now recommends release of the remaining financial
guarantee;
NOW, THEREFORE, BE IT HERBY RESOLVED BY THE CITY COUNCIL OF
THE CTTY OF PLYMOUTH, MD4NESOTA, that it should and hereby does authorize
the release of the financial guarantee in the amount of $5,970, which was submitted to
guarantee Tree Preservation for the holly Creek 3rd Addition.
Adopted by the City Council on January 3, 1995.
