wHERBAS, the City of Plymout>f as owner god Imperial Developer, Tac., as

Nosthee+eat Boulevard from 55th Avenue to Stith Avenue, City Praaeat No. 106 - Phaes

WiKERBAS, the Engineer hes certified his ace"ax of the work and his approval of
the f Ad requeg for payment.
NOW, THEREFORE, BE IT HERMY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUM, MINNESOTA:
1. That the original contract amount was $176,070.50 with no chop
order. The value of the work to date is $157,887.35 and is herewith
approved.
Z. That the work performed by the contractor for NorthwG9 Boulevard
Street and Utility Improvements and certified to the Council by the
engineer as acceptable, beim] the acme, is hereby released ftom the
engineer as accept" from the contract except as to the conditions of
the petbrmance bowl, any and all legal rights of the owner, required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 9 and Pimal in the amount of $11,586.83 to
Imperial Developers, Inc. for Northwest Boulevard Street and Utility
hVrovaneots is hemby approved and the City Finance Director is
hereby authorized and directed to pay the acme forthwith.
