APPROVDIG PRELZMXNARY PLAT AND VARIANCE FOR ABINGDON
DEVELOPMENT CORPORATION FOR PROPERTY LOCATED AT 17330 19TH
AVENUE NORTH (94133)
WHEIMA3, Abingdon Development Corporation has requested a Preliminary Phu far
The Shores of traetz Labe, a plat for 17 single family lots on 18.3 aces located at
1733019th Avenue North;
The property Is more specifically described a follows:
Part of the Southwest Quarter of the Northwest Quarter of Section 299
Township 118, Range 22 and Outlot A, Oakdale West Third Addition,
Hennepin County, Minnesota.
WMRBAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, TiMMORB, BE IT HERESY RESOLVED BY THE MY COUNCIL OF
THE CITY OF PLYMOUTH, IdIr NOTA, that it should and hereby does approve
the request of Abingdon Development Corporation for a ' Preliminary Plat for The
Sbores of Rraetz Labe, a plot for 17 single family has on 18.3 aces located at 17330
19th Avenue North: subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Remcnal of all hazardous tree from the property at the owner's expense.
3. No building permits shall be issued until a contract has been awarded for sewer
and water.
4. Payment of part dedication fees -in -lieu of dedication in accordance with the
Dedication Puliry in eRxt at the time of Ming the Final Plat in combh. Hou
with the dedication of a flve-foot trail outlot.
S. Submission of the deed for Outlot B prior to filing of the final plat with
Hennepin County.
6. Street names shall comply with the City Street Naming System.

7. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new Kmctures on sites adjacent to, or containing any open :form water
ftility.
S. No buiikft permits shall be issued until the Final Plat is filed and nacorded
with Hennepin County.
9. Incorposation of tree protection provisions in the Final Plat and Development
Contract suppr+oval.
10. A 20 -foot easement shall be created between Lou 9 and 10 to provide for
emergency vehicle access to the public trail. Tae Developer shall construct the
fire hwo to Pira Division standards and the City shall upgrade the existing 'hail
if needed.
11. The fire lane shall be constructed prior to issuance of permits for Lots 9 and 109
Block 1.
12. Appropriate legal documents regarding Homeowoera Association documents,
covenants and restrictions and approved by the City Attorney shall be filed with
the Final Plat. Ownership and maintenance of Outlet A which consists of Woe
and Woe shore property shall be included in the Homeowners Association
documents.
13. A Variance from Plymouth City Code Section 500.17, Subd. 2 is approved for
a cul -&-sac of 1,420 feet in length based on the flaiing that this plat presents
gxdd circumstances and that the Variance will not be detrimental to other
ptopertY•
14. Compliance with Department of Natural Resources letter dated June 29. 1934.

16. Denial of a Variance request for a mean lot depth of 86 feet versus 120 feet for
Lot 2. 'Ibe purpose of the request is based exclusively upon the desire to
increase value or income potential of the WW and, the Variance would be
detrimental to the public welfare in the creation of an irregularly shaped lot.
