NW -17 SANITARY SEWER

WHEREAS, the City of Plymouth at owner and Ryan Contracting, Inc.. as contractors
bm enip rod into an agreement for the NW -17 Sanitary Sewer, City Project No. 0109
said agreemact being dated January 28, 1992; and
WEERBAS; a dispute arose over ma wort claimed by the contractor as a rmk of
changed conditions and the contractor tiled suit against the City; and
WHEREAS; a settlement has been negotiated with the contractor which is
rocommended for approval by the City Council which will malm payment on the
NOW, THEREFORE, BE IT HERMY RESOLVED BY THE MY COUNCQ. OF
THE CITY OF PLYMOUTH, UNNESOTA: That MW payment in the amount of
134,000 as a negotiated settlement for all calms of the contractor associated with the
contract is busby approved.
