RESOLUTION 94-719
APPROVING FILLING WETI ANDS
AND THE WETLAND RSPI.ACEM NT PLAN FOR
WBSTBRANCH 4TH ADDITION (94104)
WHEREAS, the developers of Weubraocb 4th Addition propose to fill wetirods for the
construction of residential streets; and
WHEREAS, there are no reasonable alternatives for the km tion of the residential streets; and
WHEREAS, a Mitiption PWr was prepared replacing the wetlands in kind at a 2 to 1 ratio
which is required by the Wetland Coosecvatlon Act of 1991; and
WHEREAS, the Replacement Plan meets the requirements of the wetland Am
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCQ. OF THE
CTIY OF PLYMOUTB, MINNESOTA: That the Mayor is authorized to execute the IAU'S
Findings of Facts, approving the filling of wetlands and the Replacement Plan for wetland
restoration in Wastbanch 4th Addition subject to the following conditions:
1. Tho replacement wetland must be monitored for a five (S) year pa-iod from the date of
completion.
2. The developers wetland consultant shall submit an annual monitoring report to the city of
Plymouth on the anniversary date of the completior of the replacement wetland for a
period of five %S) years containing information required in WCA rule 8420.0620.
3. The replacement wetland must be constructed concurrently with site grading.
4. The developer shall submit a letter of credit in the amount of the coat of the Replacement
Plan. The letter of credit shall be for a period of five (S) years. If during the fiscal year
period the replacement wetland does not perform as proposed in the plan, work as
necessary shall be undertaken by the developer to bring it into conformance.
S. A deed creating a restrictive covenant running with the land for the replacement arm must
be recorded. The deed shall be submittal to the City for approval before recording.
