AUTHORIZING THE VACATION OF
COUNTY HIGHWAY NO. 10 RIGHT -0F WAY WITHIN
DSEEHAVEN ADDI'I'IeON

ofway within Deerbavon Addition; and
WHEREAS, said position was signed by a majority of the owam of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hating with respect to said vacation was scheduled for October 17, 1994 in
accordance with IW innesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of October 17, 1994; and
WHEREAS, W property owners adjacent to tt.- proposed vacation were duly notified by mail;
and
WHEREAS, the Council did bold a public hearing on October 17, 1994 to inform any and all
interested parties relevant to the vacation of a portion of County Highway No. 10 street right-of-
way within Deerhaven Addition; and
WHEREAS, it was determined by the City Council that said right of way was not needed for
public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CT1Y COUNCIL OF THE CITY
OF PLYMOUTH. bM4NESOTA: That the following potion of County Highway No. 10 right-
of-way within Deerhaven be vacated:
The south 10 feet of County Highway No. 10 right-of-way adjacent to Block 1
Deerhaven as dedicated on the recorded plat thereof, Hennepin County, MN.
FURTHER, that said vacation shall not affect the authority of any person, corporation or
municipality owning or controlling the electric or telephone poles and lines, gas and sewer lana,
water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same, to enter
upon such way or portion thereof vacated to repair, replace, remove otherwise attend thereto.
FURTHER, a permanent drainage and utility easement shall be retained over all of the vacated
County Highway No. 10 right-of-way.
