HomeMy WebLinkAboutCity Council Resolution 1994-611I CITY OF PLYMOUTH ABSOLUTION % - 611 APPROVING FELJJ 1G WETLANDS AND THE WETLAND RSFLACI1NT PLAN FOR FIIdJNG OF LESS THAN 109000 SQUABS FEET EDEN TRACE A COhV#=C1AL SUITDING OW4) Wil33RBAS, the developers of the Edea Trace property propose to fill wetlands for peen space, driveway and parking; am WH REAS, there are no reasonable alternatives for the location of the improvement; and WHEREAS, a Mitigation Plan was prepared replacing the wetlands in kind at a 2 to 1 ratio which is required by the wetland Conservation Act of 1991; acrd WHEREAS, the Replacement Plan meets the requirements of the wetland Act. NOW, 71iOMR14 BE lT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: Thu the Mayor is authorized to execute the LOU'S Findings of Facts, approving the filling of wetlands and the Replacement Plain for wetWtd restoration for Eden Trace, subject to the following conditions: 1. The replaoaaent wetland must be monitored for a five (S) year period from the date of completion. 2. The developers wetland txmsultsw shall submit an annual monitoring report to the city of Plymouth on the anniversary date of the eompietioe of the replacement wetland for a period of five (S) years containing information required in WCA rule 8420.0620. 3. The replacement wetland must be constructed concurrently with site grading. 4. Mve developer shall submit a latter of credit in the amount of the cost of the Replacement Plan. The letter of cradt shall be for a period of five (S) years. U during the fiscal year period the replacement wetlaW does not perform as proposed in the plan, work as neoesstry shall be undertaker by the developer to bring it into conformance. S. A deed creating a restrictive covenant running with the land for the replacement area must be recorded. The deed shall be submitted to the City for approval before recording.
