RESOLUTION 94 - 609
APPROVING FILUNG WETLANDS
AND THE WETI AND REPLAC81Vl NT PLAN FOR
FEL IMG LESS THAN 10,000 SQUARE FEET
HICKORY IFMJA ADDITION (94091)
WHBRBA.S, the developers of Hicloory Hills Addition propose to fill wetlands for a driveway
and multi -family home comtnw6m; and
WHZtBAS; there are no reasonable a ternatives for the location of the driveway and building
locations; and
WHBRBAS, a Mitigation Plan was prepared replacing the wetlands in kind at a 2 to 1 natio
which is required by the Wdhmd Conservation Act of 1991; and
WEMRBAS, the Replacement Plan meets the requirements of the Wetland Act.
NOW, TEREFORS, BE IT REMY RBSOLVBD BY THB CITY COUNCIL OF THE
CITY OF PLYMOUTH, IOTA: That the Mayor is authorized to execute the LAWS
Findings of Facts, approving the filling of wetlands and the Replacement Phan for wetland
restoration in Hickory Hills Addition subject to the following conditions:
1. The replacement wetWd must be monitored for a five (S) year period from the date of
Completion.
2. The developers wetland consultant shall submit an annual monitoring report to the city of
Plymouth on the anniversary date of the completion of the replacement wetland for a
period of five (5) years containing information required in WCA rule 8420.0620.
3. The repkcenent wetland must be constructed concurrently with site grading.
4. The developer shall submit a letter of credit in the amount of the coat of the Replacement
Phuh. The letter of credit shall be for a period of five (S) years. If during the fiscal year
period the replacernent wetland does not perform as proposed in the plan, wort u
necessary &hall be undertaken by the developer v bring it into conformance.
S. A deed creating a restrictive covenant running with the lard for the replacement area must
be recorded. The deed &hall be submitted to the City for approval before recording.
