Ibis policy is in accordance with Minnesota Statute 435.193-195. A hardship will be deemed to exist under the following conditions: A. 1be property is the homestead of the owner. B. 17be owner is at least 62 years of age. C. 1be owner bad a gross income of less than 61,U 517.850 for a one person household in the year before the assessment installments for loxl improvements are to be certified to County. IMe property is the homestead of the owner. Resolution No. 94-523 B. 'Ibe owner had a dross income which meets the limit detailed in I.C. above. C. The owner is retired due to a permanent and total disability which must include one of the following: 1. Certified as lepUy blind in both eyes. 2. Lou of both arms at the shoulder. 3. Loss of both legs so close to the hips that no effective artificial limbs can be used. 4. Complete and permanent paralysis. S. Tbtal and permanent loss of mental facilities. 6. Any other injury which prevents the owner from working and earning an income that exceeds the limit ad forth in I.C. above. 11 ,. 1 1 r ITT � a 97" MI17I a, A. 71e City Council will review the income limit for this program when it reviews the income guWelirres for the Housing and Redevelopment Home Improvement Grant Program. Tltis review usually occurs in early August. B. Applications for this program aro available from the City. Applications must be submitted before November 30. C. Applicants must supply the infon ution required on the application and any supplementary documentation necessary to ewblish and verify the following: 1. T1ne legal description and property Ifttification number 2. T1ro street address. 3. That it is homestead property of one acre or less. 11ro only exception is for those parcels that are five acres or leu and which may not be subdivided without additional public improvements. 4. That the property owner retired because of permmemt and total disability as defined in dds policy. 8. That paying the R=W assessment on the ordinary acbmb& conadputes a hardship as defined in this policy. D. Simple intrust will accrue for the term of the assessment on any principal of the special anesameot which is deferred. After the term of the ameamaat expiress no more interest will accrue. B. The Finance Director will determine whether an applicant is elide based upon this policy and state law. F. The Finance Director will maintain special assessment deferral records and will annually update the city Council on deferments approved under this policy. O. The City will establish a revolving ftmd to pay the deticdency in bond redemption imstallmemta arising from specW asses:meed deferments. Accrued deferred inmllments of special assessments and interest at the time of terminatiom of the deferment will be paid into this had.
