APPROVING MD® PLANNED UNIT DEVELOPMENT PRE UOUNARY
PLAN/PLAT AND CONDITIONAL USE PERMIT FOR MCHUNTER COMPANY
LLC FOR PROPERTY LOCATED SOU79WBST OF COUNTY ROAD 10 AND
TREN'T'ON LANE NORTH (9405 1) (h1PUD 94-1)
WHEREAS, McHunter Company ILC has requested approval for a MPUD
Preliminery Plan/Plat and Conditional Use Patmit for property located southwest of
County Rad 9 and Trenton Ione North,
The property is more speeif tally described as follows:
That part of the east half of the Southwest Quarter of Section 1, Township 118,
Range 22, Hennepin County, Minnesota, described as follows:
Beginning at the northwest corner of said east half of the Southwest Quarter,

WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Haring mid mcommenda approval;

THE Crff OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request of McHuoter LLC for a Minced Phmed Unit Development P1 W7W and
Conditional Use Permit for property located soudnrest of County Road 10 and 'Ileoton
Laos North, subject to the following conditions:
1. Compliance with the City Boginew's Memorandum.
2. Removal of all hazardous um from the property at the owner's egwn.
3. No building permit shall be issued until a contract has been awarded for sewer
and water.
4. Park dedication requirements have been satisfied by previous approvals for the
Ponds at Baca Creek development.
S. Street nnnes shall comply with the City Street Naming System.
6. Compliance with Policy Resolution 79-80 regarding minimum floor ebvadons
fo new dnftnres on sites adjacent to, or containing any open storm water
drainage ftifity.
7. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepin County.
B. Private driveway access shall be limited to internal public roads and restricted
from County Road 10.
9. Final Phu mykn shall refer to MPUD 94.1.
10. Appropriate legal documents regarding Homamm n Association documents,
covenants and restrictions as approved by the City Attorney shall be filed with the
Fiat) Phu.
11. The submission of required Financial Guarantee and Site Performium Agreunent
for completion of site improvements within 12 months of the date of this
Resolution.
12. Any dgnage shall be in compliance with the Zoning Ordinance and the approved
plans for the Harrison Place on Baa: Creek development.
13. Any subsequent phases aro subject to required reviews and approvals per
Ordinance provisions.
14. Compliance with the Ordinance regu+ding the location of hydrants and fire lanes.

1S. A minimum ten foot wide deed restriction to create a buffer of natural vegetation
immediately adjacent to all wetlands shall be recorded to restrict private
developmeot.
16. Inwllstion of four -foot high decorative 4' by 40 posts at 20 -foot intervals,
delineating the wetland boundary within each lot. Installation of the posts shall
be secured by a Financial Guarantee.
17. The developer shall provide notification of wetland .aguladm in Purchase
agreements with homeowners and provide covenants as part of the Homeowner's
Association documents that detail wethod and buffer loos restrictions. Thee
documents shall stipulate that the homeowner must maintain the buffer none in a
natural vegetative state and that mowing in the buffer shall be prohibited.
18. The developer shall provide education materials to homeowners that will address
pollution reduction from for dinent herbicides and pesticides.
19. The developer sball convey drain and ponding easements to the City that will
encumber all wedannds on the site.
20. The development shall include construction of on-site basins for storm water
treatment that meet the National Urban Run Off Program (NURP) water quality
guidelines as well as the Minneaota Pollution Control Agency's Best Management
Practices Manual and Shingle Creek's water quality requirements.
21. The developer shall sign an agreement with the city for future maintenance of the
storm water treatment ponds in acoordanee with the standards of City policy.
22. Strict adherence to the City's BroSion Control Policy Shall be met.
23. The find landscaping Plan shall include additional plantings along the south
portion of the townhomes to provide an adequate buffer to the single family lots.
24. Compliance with the terms of City Council Resolution 89-439 regarding tree
preservation.
25. The PUD Preliminary Plan is in compliance with the Conditional Use Permit
Standards for multi -family development.
26. Any filling within the Flood Plain Overlay District shall require application for a
Conditional Use Pemdt which shall be reviewed at the time of PUD Find
Plan/Plat application.
