WHMU MS, Janco, Inc. has requested an Amended planned Unit Development plan,
Preliminary Plan/Plat and Conditional Use Permit for Forster, preserve plat Two for
property located northwest of Balsam Lane and Old Rochford Road;
The property is more specifically described as:
That pan of Outlot A, Forster Preserve, according to the recorded plat thereof,
Hennepin County, Minnesota.
The weal 300 feet of that pan of the Southeast Quarter of the Northeast Quarter
of Section 14, Township 118, Range 22, lying north of Rockford Road; subject
to an easement over the weal 30 fat thereof for road purposes, as combined in
deed Doc. No. 392608, Fie: of Registrar of titles, Certificate of Title No.
299683; also,
That part of the west 270 feet of the east 738 feet of the Southeast Quarter of
the Northeast Quarter of Section 14, Township 118, Range 22, as measured on
the north and south tares tuereof, lying north of Rockford Road.
The west half of the following parcel: That put of the Southeast Quarter of the
Northeast Quarter except the east 738 feet, as measured on the north south lima
thereof, of Section 14, Township I IS, Range 22, lying north of Rockford Road,
except the west 300 feet thereof, also,
The east half of the following described parcel: That pan of the Southeast
Quarter of the Northeast Quarter except the east 738 feet, as measured on the
north south line-,% thereof, of Section 14, Township 118, Rance 22, lying north
of Rockford Road, except the west 300 feet thereof; also,
That part of the Northeast Quarter of the Nonlesrt Quarter of Section 14,
Township 118, Range 22, Hennepin County, Minnesota lying south of the
southerly right-of-way line of County State Highway No. 9 aq described in
Final Certificate Document No. 6034928 and lying west of the northerly
extension of the east line of the west 270 feet of the east 738 Net of the
Southeast Quarter of the Northeast Quarter of said Section 14 as measured along
the north south line thereof.

WHEREAS, the Pbanlag Commission bas reviewed said request at a duly called
Public Haring and recommends approval;
NOW, TiTEREFORB, BE TT HEREBY RESOLVED BY THE CITY COUNaL OF
THE CITY OF PLYMOUTH, MINNESOTA, tbat it should and hereby does approve
the request of Janco, Inc. for an Amended Planned Unit Development Plan,
Preliminary PWPlat and Conditional Use Permit far property located oortbweat of
Balsam Law and Old Rooldord Road, subject to the following conditions:
I. Compliance with the City Engineer's Memorandum.
2. Removal of all hazardous tree: from the property at the owner's expense.
3. No building permit shall be issued until a contract has been awarded for sewer
and water.
4. Payment of park dedication tees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of recording the Final Plat.
3. Street names shall comply with the City Street Naming System.
6. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for
new structures on sites a4jacent to, or conaaining any open storm water drainage
facility.
7. No building permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
B. Private driveway access shall be limited to WmW public roads and restricted
from County Road 9.
9. Transitional screening shall be provided along County Road 9.
10. Final Plat mylars shall refer to RPUD 94-2.
11. Appropriate legal documents regarding Homeowners Association documents,
covenants and restriction as approved by the City Attorney shall be filed with
the Final Plat. Specific reference shall be made to the maintenance of the
screening face along County Road 9 and to notification and description of the
activities of Forster Mat Market.
