WHEREAS, on the 20th day of June, 1994 the City Council adopted a resolution which
fixed a date for a public hearing with respect to the improvements to 26th Avenue from
State Highway 169 to Medicine Ridge Road; and
WHBRBAS; the proposed project included the installation of 32 foot wide, 9 -tom roadway
with concrete curb and gutter, storm aewer, and an 6 foot wide bituminous trail along the
south boulevard and all neoessary appurtenances; and
WHEREAS, ten days published notice of hearing through two week publications of the
required notice was given and the hearing was held thereon the 25th day of July, 1994, at
which time all persons desiring to be heard were given an opportunity to be hard thereon;
NOW, THEUWORB, BE IT HBRBBY RBSOLVBD BY THB CITY COUNCIL OF THE
CIW OF PLYMOUTH, MINNESOTA:
1. Such improvement is hereby ordered as proposed in the Council resolution
adopted June 20, 1994, with the following provWons:
1. The street shall be 32 fed wide face to face of curb with the
centerline one foot north of the centerth a of the right-of-way, with a
northerly bend at the westerly and of the project if feasible from an
engineering perspective.
2. Option 3 shall be used for the intersection of Medicine Ridge Rtmd
(900 intersection).
3. That pending assessments be established $45.64/ft. for properties with
driveway access and $7.76/ft. for properties with no driveway access,
subject to future consideration following the assessment hearing.
4. That hur&Wing be provided along the south edge of the trail for the
property adjacent to Medicine Ridge Road as mitigation for tree
removal within the street right of way.
5. That there shall be no parking on the stmet and bike lanes of 5 feet in
width on both sides of the street shall be striped.

6. That an 'All -Way' trop at Nathan Law will be evaluated upon
