REVISING THE STANDARDS OF :i: SHORELAND OVERLAY DISTRICT

WHEREAS, the City Council adopted Sboreiand Management Regulations in 19829 as
required by State Law, with the addition of Section 6, Subdivision Bs tie ShoreLrod
Management Overlay District; and,
WHEREAS, the State Department of Natural Resources (DNR) adopted rules in 1989
which mandate charsea to the City's regulations to bring them into substantial
compliance with the new rules; and,
WHEREAS, a draft ordinance prepared in response to the State Lw was reviewed at a
public informational meeting on June Be 1994s and a duly called public hearing was
bold by the Planning Commission on June 22, 1994 when the Commission
recommended approval of the ordinance; ands
WHEREAS, the City Council adopted an ordinance which amends the Zoning
Ordinance, and an official map, on July 11, 1994:
NOW, 3FORE4 BE IT REMY RESOLVED BY THE CITY COUNCIL OF
THB CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does declare
the following to be a summary of the ordinance and official map adopted July 11,
1994, complete copies of which aro on file with the City Clerk:
A. The following dentitions in Section 4, Subdivision B are revised:
*Bluff abe ane Top)•, *Public Waters", •Sboreland•, and `wetland'.
A number of terms related to Sboreland Management, including these,
and based upon the 1989 DNR rules, were adopted by the City in 1992.
B. The following parts of Section 6, Subdivision B are changed: the
number refer to the parts:
1. Purpose. Reference to State Lw clanged.
3. General Provisions. Reference made to the Shweland
Management map which is also adopted; various lanes and
tributaries (scrams) are identified using official DNR
dek-riptions, language clarified.

4. General Density and Design Smndards. ClA ft language about
reladorsbip of standards to underiyiol; zoning district, minimum
lot sine exception lots, minimum atnucpue setbacks and about
general requirement and exceptions.

S. Conditional Use Requirements and Procedures. Add language
that consolidatea all related items into one part, and updates
standards to be consistent with State Rules.
6. Subdivision Requirements and Procedures. Chrity and add new
language about lard mdW llky and inconsistent plats. Add
standards for lots proposed to serve u controlled aooess.
7. Planned Unit Developments. Ch fify and add langtuge about
procedru+es and standards to ensure consistency with intent of
State Lw, while retaining traditional design fbxM ty and
density calculation procedures.
8. Provisions for water and Disposal of Sewage and Solid Wade -
Clarity language about standards of odor agendies. Add setback
standard for tributary streams. Add standards about ticilittes that
are inconsistent with applicable laws; about correction of
deficbocies; and about education of owners of on-site sanitary
systems.
9. Special Requirements for Development in and Alterations to
Shorelard and for Agricultural Uses. Clarity standards about
tree clear -cutting cad vesettive clearing. Add language about
grading and fWing in certain areas, and about any work below
the ordinary higb water level. Add standards about use of
staimays, lifts, and landings in bluff and steep slope arca; add
language about conswction an deep slopes. Add standards for
ag icuhcual wet.
10. Variaooes. Clarify language about bearing and notification
proceduta•
11. Non-confarm uses. Add bmguage that comoli tes all related
items into one put, and updates standards to be consistent wkh
State Rules regarding subMandard lots.

Guide Plan.
C. A map define ft the area mbject to the Sboreland Management
Regulations and containing inbrmation describing the Ordinary High
water LQvels of public Maters in the City was adopted.
FURTHER. BE IT RESOLVED, that this ordinance summary shall be published in the
City' a legal newspaper in lieu of the entire text of the ordinance.
