The property is more specifically described as follows: Outlet 0, Westbnanch, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said res nest at a duly called Public Hearing and recommends approval; NOW, IHERBFORB, BE rr HEREBY RESOLVED BY n B C -W COUNCQ. OF THE CrrY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the tequest of Orrin Zbompson Homes for an Amended Planned Unit Development Plan, Conditional Use permit and Variance for property located mat of Dunkirk Lane and 40th Avenue Norte, subject to the following conditions: 1. No other amendments or vuianoes are granted or implied. 2. 'lee granting of this RPUD Preliminary Plan Amendment is consistent with the standards of the Ordinance for RPUD Plan and Conditional Use Permits. 3. The RPUD Preliminary Plan for the West Branch Addition (formerly known u Plymouth Creek Heights) is hereby modified to provide the following yard setbacks: a. 25 -foot front yard setback for Lots 13, 14, 13, 16 and 17, Block 3 b. 25 -foot front yard setback along 39th Avenue North and a 10 -foot roar yard setback for Lot S, Block 4. 4. Compliance with the terms and conditions of Resoludoa 93.221 and Resolution 93.222 approving the RPUD Concept Plan and Preliminary Plan/Plat and Conditional Use Permit. S. A Variance is granted for a cul-de-sac length of 680 feet based on the finding that the request meets the variance standards. Adopted by the City Council on July 11, 1994. C
