WHEREAS, the City Council has approved the Final Plat and Development Contact
for Suer HMW 3rd Addition located at the intersection of 36th Avow North and
County Road 9; ands
NOW, 1H BREFORB, BE IT HBRESY RESOLVED BY THE Cii'IY COUNCIL OF
THE CITY OF PLYMOUTH, Iv1 MNESOTA, that it should and hereby does approve
the following to be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of part dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in ef%ct at the time of Ming the plat.
3. No building permits shall be issued until a contact has been awarded for the
construction of municipal aewrar and water.
4. Removal of all hazardous trees from the property at the owner's expanse.
S. Compli nce of Policy Resolution 79.80 regarding minimum factor elevations for
new structures in subdiviaion 4acent to, or containing any open storm water
drainage facility.
6. Submittal of required utility and drahap easements as approved by the City
Hngineer prior to tiling the Final Plat.
7. No building permits to be issued until the Final Plat is tiled and recorded with
Hennepin County.
S. Appropriate legal document regarding Homeowner AssocWon covenant and
restrictions as approved by the City Attorney, shall be tiled with the Final Plat.
9. Tiro FiW Plat myhus shall contain a statement noting :hat the plat is part of the
approved MPUD 92-1, per Suction 9 of the Zoning Ordinance.
10. Access shall be Whited to internal public roads and prohibited from 36th
Avenue North and County Road 9.
