CITY OF PLYMOUTH
RESOLUTION %. 294
AUTHORIZING THE VACATION OF
MAGNOLIA LANE STREET RIGHT OF WAY
ZLN HMT HEIGHTS ADDITION
WHEREAS, a petition was &vdved to vacaoe a portion of Magnolia Lane street right
of way in Elmhurst Herts Addition; and
w w.BAS; a public bearing with respect to said vacation was scheduleot for May 16,
1994 in accordance with Minnesota Statutes 412.851 as amended; and
WHEREAS, a notice of publication of said bearing was published and posted two
weeks prior to the meeting of May 16, 1994; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified
by mail; and
WHEREAS, the Council did bold a public hearing on May 16, 1994 to inform any and
all interested parties relevant to the vacation of a portion of Magnolia Lane street right
of way in Elmhurst Addition; and
WHEREAS, it was determined by the City Council that said easements were not
needed for public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of Magnolia
Lane west right of way in Elmhurst Heights Addition be vacated:
The north 58.8 feet of Magnolia Lane as platted in Elmhurst Heights
Addition according to the plat thereof on file or of record in the office of
the Registrar of Title, Hennepin County, MN.
FURTHER, that said vacation shall not affect the authority of ani person,
corporation or municipality owning or controlling the electric or telephone poles
and linea, gas and sewer lines, water pipes, mains and hydrants thereon or
thereunder, to continue maintaining the same, to enter upon such way or portion
thereof vacated to repair, replace, remove other attend thereto.
FURTHER, subject to a drainage and utility easement over, under, and across all of
vacated Magnolia Lane street right of way.
Adopted by the City Council on May 16, 1994.
