SBrMG CONDITIONS TO BE MET PRIOR TO FTIIIO OF THE RELATED
MKID FINAL PLAT FOR ROTTT.UND HOMES, INC. FOR PINTAQ, VIIZ.AS
FOR PROPERTY LOCATED ON THE BAST SIDS OF SHENANDOAH LANE AT
22ND AVENUE NORIB (MPUD 83-1) (93065)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Rout nd Home, Inc. for Pintail Vials boded on the aril side of Sbenandoeb Lane
at 22nd Avenue North;
NOW, ISR WOM BE IT HBRBBY RBSOLVEO BY THE CITY COUNC L OF
THE CITY OF PLYMOUTH, MINNB.SOTA, that it should and hereby does approve
the following to be met, prior to reoording of, and related to said plat:
1. Compliance with the City Bagineer's Memorandum.
2. No building permits still be issued until a contract bas been awarded for the
construction of Municipal sewer and water.
3. Removal of all bazardous trees from the property at the owner's expense.
4. Compliance of Policy Resolution 79-80 re8ardinj minimum floor ebvatioos for
new unm uuu in subdivisions adjacent to, or containing any open smrm water
drainage facility►.
5. Submittal of required utility and drainage esemeab as approved by the City
Bogineer prior :„i thing the Final Plat.
6. No building permits to be blued until the Final Plat is filed and recorded whh
Hannapin County.
7. Appropriate legal documeab regarding Homeowner Association covenants and
restriction, as approved by the City Attorney, "be filed and reoorded prior
to Issuance of the Certificate of Occupancy.
B. The Final Plat mylan shall contain a statement noting that the plat is part of the
approved MPUD 83-1, per SeWon 9 of the Zoning Ordinance.
9. The Development Control, as approved by the City Council, shall be Polly
executed prior to release of the Final Plat.
10. The Homeowners Association dommeet tiled with this applicadon shall norma

11. No Sbooea or other building structures shall be located within the 25 -foot front
yard setback or along Shenandoah Lae or Raechview Lama
12. Access shall be limited to internal public mads and prohibited from Sheou dosh
Laos.
13. Subminion of the required financial guarantee and Site Impravemeat
Performance Agreemeet for completion of site improvemaib within 12 months
of the date of this resolution
14. All waste and waste contaimer.% shall be stored within the principal structures,
and no outside stoup is permided.
15. An 81/2 x 11 inch 'As -built' fire protection plan shall be submitted prior to the
release o. reduction of any site improvement bonds per City per•
16. Development shall comply with the applicable requirements of Resohniou 84-
14, 84-323, 87-176 and 87-337, and, an executed development oonbmml for the
Purines Labe development --Stage B, Parkers Labe North.
17. The development shall comply with the approved Baviroemental Import
Statement and related permits.
18. All park dedication requirements have been saddled with prior development
contacts for the Parker: Lake North MPUD.
19. 'lion MPUD Final Plan is for 144 dwelling units.
20. T'he total amnerical midIxAnts of the density in all areas must &pd 1,147
units. If the Final Plat is developed above or below the midVint of the density
range included in an approved PUD l"Uminary Plat, then the density mage in
other areas must be changed so that the Innaity of the land platted plus the mid-
point of all areas, equal& the maximum number left --1,147. with each
application for raidentW plan/plat approval, the petitioner shall submit an
accounting of the number of units remaining, by area, along with the number of
units that hav,3 been developed. Any reduction or increase in the numhc- of
units from the established mage, and a maximum number of units, dull require
an amendment to the Planned Unit Development. Similarly, each FM Plat
request shall include a status report totting the level of unitary sewer demand
