HomeMy WebLinkAboutCity Council Resolution 1994-230• CITY OF PLYMOUTH RESOLUTION % 230 APPROVING FILiMG WBTLANDS AND THE WETLAND REPLACEMENT PLAN FOR CRESRSIDE ESTATES (93125) WHEREAS, the developers of the CceeiWde Estates property propose to fill wetlands for an ap utment building for the elderly and necessary pig; and WiliHiBAS; there are no reasaable alternatives for the location of the apartment building; and WHEREAS, a Mitigation Plan was prepared replacing the wetlands in kind at a 2 to 1 ratio which is required by the Kielland Conservation Act of 1991; and WHEREAS, the Replacement Plan meets the requirements of the WetWd Act. Now, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL Oi+ THE CITY OF PLYMOUTH, MINNESOTA: Thu the Mayor is authorized to execute the LOU'S Findings of Facts, approving the filling of weVands and the Replacement Pian for wetland restoration in the Creeimide Estates property subject to the following conditions: 1. The replaoanent wetland must be monitored for a five (3) year period from the date of completlon. 2. The developers wetland consultant shall submit an annual monitoring report to the city of Plymouth on the anaiversary date of the completion of the replacement wetland for a period of five (5) years containing information required in WCA rule 8420.0620. 3. The replacement wetland must be constricted concurrently with site grading. 4. The developer shall submit a letter of credit in the amount of the cost of the Replacement Plan. The letter of credit shall be for a period of five (S) years. If during the five year period the replacement wetland does not perform as proposed in the plan, work as necessary shall be undertaken by the developer to bring it into conformance. 3. A deed creating a restrictive covenant running with the land for the replacement area must be recorded. The deed shall be submitted to the City for approval before recording. Adopted by the City Council on April 18, 1994
