HomeMy WebLinkAboutCity Council Resolution 1994-229C CITY OF PLYMOUTH RESOLUTION % - 229 APPROVDIG FnJMG WETLANDS AND THE WETLAND RM ACEbUNT PLAN FOR PRBSBYTERY CHURCH OF THE TWIN Cl7= AREA (93141) WiIBREAS, the developers of the Presbyterian Church property propose to fill wetlands for a church building arid necessary parking; and WHBRBAS; there are no reasonable alternatives for the location of the church building and construction of the necessary parking; and WEEREAS, a Mitigation Plan was prepared replacing the wetlands in kind at a 2 to 1 ratio which is required by the Wetland Conservation Act of 1991; and WHEREAS, the Rsolaam:mt Plan meet the requirements of the Wetland Act. NOW, THEREFORE, BE IT HEREBY RBSOLVBD BY THE CITY COUNCEL OF THE CITY OF PLYMOUTH, MIDe SOTA: Ther the Mayor is authorized to execute the LOU'S Findings of Fact, approving the filling of wetlands and the Replacement Plan for wetland restoration in the Presbyterian Church property. Subject to the following conditions: 1. The r+eplaoesnent wetland must be monitored for a five (S) year period from the date of completion. 2. The developers wetland consultant shah submit an annual monitoring report to the city of Plymouth on the anniversary date of the completion of the replacement wetland for a period of five (5) yam containing information required in WCA rule 8420.0620. 3. The replacenent wetland must be constructed concurrently with site grading. 4. The developer shall submit a letter of credit in the amount of the cost of the Replacement Plan. The letter of credit shall be for a period of five (S) yam. U during the five year period the replacement wetland does not perform as proposed in the plan, work as necessary shall be undertaken by the developer to bring it into conformance. S. A deed creating a restrictive covenant running with the hurt for the replacement area must be recorded. The deed shall be submitted to the City for approval before recording. 6. Approval of the Mhuwhaha Creek Watershed for the grading plan. Adopted by the City Council on April 18, 1994 •
