HomeMy WebLinkAboutCity Council Resolution 1994-228• CITY OF PLYMOUTB RESOLUTION 94-228 APPROVING FEUING VYRTIANDS AND THE WETLAND RBPI.ACEMZNT PLAN FOR BANNER ENGINEE KING (931126) WHBRBAS, the developers of the Bum ftimerift property propose to till wetlands for a Research and Redevelopment building; and WHBRBAS; there are no reasonable alternatives for the location of the Research and Development building ; and WHEREAS, a Mitigation Plan was prepared replacing the wetlands in kind at a 2 to 1 ratio which is required by the Welland Conservation Act of 1991; and WHEREAS, the Replacement Plan meets the requirements of the Wetland Act. NOW, nMRBPORS, BE 1T HBRBBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, hC NNBSSOTA: That the Mayor is authors: od to execute the LAW'S Findings of Fads, approving the filling of wetlands and the Replacemem Plan for wdWW re:<omdon in the Banner Brlineering Property subject to the following conditions: 1. The replacement wetland must be monitored for a five (S) year period from the date of completion. 2. The developers weds nd consultant shall submit an annual monitoring report to the city of Plymouth on the anniversary date of the completion of the replacement wetland for a period of five (S) years containing information required in WCA rule 8420.0620. 3. The replacement wetland must be constructed concurrently with site gfwft. 4. 7% developer shall submit a letter of credit in the amount of the cost of the Replacement Plan. The letter of credit shall be for a period of five (S) years. If during the five year period the replacement wetland does not perform u Proposed in the plan, work as necessary shall be undertaken by the developer to bring it into conformance: 3. A deed creating a restrictive covenant running with the land for the replacement area must be recorded. The deed &hall be submitted to the City for approval before recording.
