APPROVING STIR PLAN AMENDMBIT AND CONDITIONAL USE PERMrr
FOR TOLL COMPANY FOR PROPERTY LOCATED AT 3005 NIAGARA LANE
NORTH (93133)
WHEREAS, Toll Company has requested a Site Plan Amendment and Conditional Use
Permit for a property located at 3005 Nlapra Lane North;
The property is more specifically described as follows:
Lot 4, Block 1, Playhouse Industrial Parr 2nd Addition, Hennepin County,
Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Haring and recommends approval;
NOW, THIM"Olt% RB 1T HEREBY RESOLVED BY TWA CITY COUNCIL OF
THE CITY OF PLYMOUTH, M@NNBSOTA, that it should and hereby does approve
the request of Toll Company for Site Plan Mneodment and Conditional On Permit for
property located at 3005 Niagara Lure North, subject to the foilowing conditions:
1. Compliance with the City Engineer's Memorandum.
2. Compliance of Policy Reaoludon 79-80 regarding minimum flew ekvatiooa for
new stroaures on site$ &Qaceot to, or containing any open storm water drainage
facility.
3. Submission of required financial guarantee and Site Performance Agreement for
completion of alte improvements within 12 months of the date of this resolution.
4. Any signage shall be in compliance with the Ordinance.
S. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
6. Compliance with the Ordinance regarding the location of fire hydrants and fire
lanes.
7. Ali waste and waste containers shall be stored in the building.
8. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bond& per City Policy.

9. MW Conditional Use Permit is for the outside amp of vehicles. MW outside
map sail be screened from view from W a4joinhig propeetda by a 6 -foot high
cedar fence.
