RESOLUTION 94 - 51
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF THE RELATED
FINAL PLAT FOR COMMERCIAL PROPERTY ASSOCIATES FOR "REBECCA
WOODS" FOR PROPERTY LOCATED AT COUNTY ROAD 101 AND 22ND
AVENUE NORTH (93121)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for "Rebecca Woods" located at County Road 101 and 22nd Avenue North; and,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the following to be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with the
Dedication Policy in effect at the time of filing the plat for four of the five lots.
Park fees have been paid for the existing home.
3. Submittal of a park trail easement covering the existing park trail in the
southeast comer of outlot A prior to recording the Final Plat.
4. No building permits shall be issued until a contract has been awarded for the
constriction of municipal sewer and water.
5. Removal of all hazardous trees from the property at the owner's expense.
6. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
7. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
8. No building permits to be issued until the Final Plat is filed and recorded with
Hennepin County.
9. Private drive access shall be limited to internal public roads and prohibited from
County Road 101 except that the existing private drive to County Road 101
shall be removed prior to issuance of building permits on Lot 1, Block 1.

10. Building setback shall be in accordance with the Rl-A Zoning District except
that variance is granted for a 25 foot front yard setback for Lot 4 Block 1.
