HomeMy WebLinkAboutCity Council Resolution 1994-038CITY OF PLYMOUTH RESOLUTION 94 -38 APPROVING A SITE PLAN, CONDITIONAL USE PERMIT AND VARIANCES FOR FREEMAN'S INC. LOCATED SOUTH OF HIGHWAY 55, EAST OF NATHAN LANE, AND NORTH OF SHELARD PARKWAY (93125) WHEREAS, the Freeman's Inc. has requested approval of a Site Plan, Conditional Use Permit and Variances for Creekside Estates located south of Highway 55, east of Nathan Lane and North of Shelard Parkway. The property is more specifically described as follows: Outlot A, Willow Grove Office Park 2nd Addition, Hennepin County, Minnesota. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with appropriate credits in amount determined according to verified paving costs and according to the Dedication Policy in effect at the time of filing the final plat with Hennepin County. 3. A trail/sidewalk shall be constructed along Nathan Lane in accordance with City specifications. A 30 foot trail easement shall be filed with the Final Plat. 4. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 5. Submission of required financial guarantee and Site Performance Agreement for completion of site improvements. 6. Any signage shall be in compliance with the Zoning Ordinance. 7. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. File 93125, Page 2 RESOLUTION NO. 94-38 • 8. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 9. All waste and waste containers shall be stored within the enclosure structure, and no outside storage is permitted. 10. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 11. Variances are granted for a: a. five foot drive aisle setback to the side property line b. five foot parking setback to the side property line. 12. Conditional Use Permit is granted for the construction of 60 foot four story apartment building based on the finding that the project meets the Conditional Use Permit criteria for height increased height. 13. A Wetlands Mitigation Plan shall be approved by the City Council prior to issuance of a building permit. 14. The sewer and water lines, as shown on the utility plans, shall be revised to comply with City regulations. Adopted by the City Council on January 24, 1994.
