HomeMy WebLinkAboutCity Council Resolution 1994-035CITY OF PLYMOUTH RESOLUTION 94-35 APPROVING AMENDED CONDITIONAL USE PERMIT FOR HERITAGE WOODS ESTATES 2ND ADDITION LOCATED WEST OF NORTHWEST BOULEVARD AT 56TH AVENUE NORTH (93119) WHEREAS, Tom Graham on behalf of the homeowners within Heritage Woods Estates 2nd Addition has requested an Amended Conditional Use Permit for property located west of Northwest Boulevard at 56th Avenue North. The property is more specifically described as follows: Heritage Woods Estates 2nd Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Tom Graham on behalf of the homeowners within Heritage Woods Estates 2nd Addition for an Amended Conditional Use Permit for property located west of Northwest Boulevard at 56th Avenue North, subject to the following conditions: No other amendments of variances are granted or implied. 2. The granting of the permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD Plans. The PUD Amendment is to eliminate the requirement for sidewalks within the Heritage Woods Estates 2nd Addition. 4. The developer of Heritage Woods Estates 2nd Addition, Graham Land Development Company, has agreed to relinquish $25,000 originally intended for construction of sidewalks and other improvements in the development to the Homeowners Association for Heritage Woods Estates 2nd Addition for their use as deemed appropriate by the Homeowners Association for Heritage Woods Estates 2nd Addition. Adopted by the City Council on January 24, 1994.
