HomeMy WebLinkAboutCity Council Resolution 1993-819CITY OF PLYMOUTH RESOLUTION 93- 819 APPROVING PRELIMINARY PLAT AND VARIANCE FOR COMMERCIAL PROPERTY ASSOCIATES FOR REBECCA WOODS LOCATED AT 2220 COUNTY ROAD 101 (93121) WHEREAS, Commercial Property Associates has requested a Preliminary Plat for Rebecca Woods, a plat for 5 lots on 5.9 located at 2220 County Road 101; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, TMEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Commercial Property Associates for a Preliminary Plat for 5 lots located at 2220 County Road 101, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No building permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 7. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 8. Incorporation of tree protection provisions in the Final Plat and Development Contract approval. 9. Oudot A shall be deleted and a 30 foot trail easement shall be provided to the City prior to filing of th,- aminal Plat with Hennepin County. 10. A covenant shall be placed on Oudot B stating that the outlot cannot be built on. • • RESOLUTION NO. 93-819 11. The Final Plat submitted shall include right-of-way dedication for County Road 101 in conformance with Hennepin County requirements of a minimum 50 foot right-of-way dedication from the center line of County Road 101. 12. The Final Plat submitted shall conform with Hennepin County requirements for minimum sight distances. 13. Private drive access shall be from internal streets and prohibited from County Road 101. 14. A Variance is granted for a ten foot side yard setback from the common lot line between Lot 1 and 2, Block 1 based on the finding the request meets the variance criteria. Specifically, the site has unique circumstances related to existing home, the angle of the intersection of 22nd Avenue North and County Road 101 and the additional ten feet right-of-way required to be dedicated for County Road 101. 15. Final Plat submitted shall reflect the modified lot line between Lots i and 2, Block 1 16. A Variance is granted for a 25 foot front yard setback for Lot 4 Block 1.
