HomeMy WebLinkAboutCity Council Resolution 1993-817CITY OF PLYMOUTH RESOLUTION 93-817 APPROVING LAND USE GUIDE PLAN AMENDMENT FOR CARLSON REAL ESTATE COMPANY FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF CARLSON PARKWAY AND I-494 (93117) WHEREAS, Carlson Real Estate has requested reclassification of the land use guiding from IP (Planned Industrial) to CR -2 (Retail Shopping) for property located at the southeast corner of Carlson Parkway and 1-494; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, iVIINNFSOTA, that it should and hereby does approve the request by Carlson Real Estate for reclassification of the land use guiding for approximately 21.7 acres from IP (Planned Industrial) to CR -2 (Retail Shopping) for property located at the southeast comer of Carlson Parkway and 1-494, subject to the following conditions: FURTHER, approval of the Land Use Guide Plan Amendment is contingent upon, and subject to, the required review and response by the Metropolitan Council, and the Final Plat which shall be approved by the City Council prior to finalization of the amendment. Development shall take place in accordance with the General Development Plan of File 93117. A deed restriction shall be filed on the property restricting the use of the site for a Sam's Club. If the property ceases to be used as a Sam's Club, the zoning for the property shall revert back to its previous Industrial zoning. The City of Plymouth shall be made a party to the deed restrictions. The deed shall be reviewed by the City Attorney's office prior to recording the deed. Adopted by the City Council on December 20, 1993.
