FOR PRGDERTY LOCATED AT THE SOUTHEAST CORNER OF THE EXTENSION OF SCHMIDT LAKE ROAD AND FUTURE EXTENSION OF FERNBROOK LANE (93112) WHEREAS, Lundgren Bros. Construction, Inc. has requested a Preliminary Plat for 46 single family lots and five outlots for property located at the southeast corner of the extension of Schmidt Lake Road and future extension of Fembrook Lane; and WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE rr HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Lundgren Bros. Construction, Inc. for a Preliminary Plat, for 46 single family lots and five outlots for property located at the southeast corner of the extension of Schmidt Lake Road and future extension of Fembrook Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum, except for Items 25.B. and 25.C. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat. 3. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. 4. Any signage shall be in compliance with the Ordinance. 5. Compliance with the Ordinance regarding the location of fine hydrants and fire lanes. 6. No building permit to be issued until the Final Plat is filed and recorded with Hennepin County. 7. Setbacks shall be a 35 foot front yard, 10 foot side yard, 20 foot rear yard and a 50 foot front yard setback to Schmidt Lake Road. 8. A variance is granted for a cul-de-sac length of 800 feet versus the Subdivision Code limit of 500 feet. RESOLUPION NO. 93-777 9. Outlots B, C, D and E shall be owned and maintained by the Homeowners Association. 10. Approval by the City Council of the wetlands report submitted in response to the Wetlands Act of 1991. 11. Removal of all dead or dying trees from the property at the owner's expense. 12. No building permits shall be issued until a contract has been awarded for sewer and water. 13. Street names shall comply with the City Street Naming System. 14. Rezoning shall be finalized with the filing of the Final Plat. 15. Appropriate legal documents regarding Homeowners Association covenants, as approved by the City Attorney, shall be filed with the Final Plat. 16. Access shall be limited to internal public roads and prohibited from Schmidt Lake Road and Fernbrook Lane. 17. A 30 foot trail outlot shall be deeded to the City at the end of 48th Avenue North to provide trail access to a future City Park, 18. A park trail shall be constructed by the City through the "trail outlot" at such time that the City deems necessary. 19. The shared driveway design for Lots 1 and 2, Block 3, shall meet City Fire Department requirements for a Fire Department access. Adopted by the City Council on December 6, 1993.
