APPROVING SETTLEMENT AGREEMENT
SPECIAL ASSESSMENT APPEAL

MEDINA ROAD IMPROVEMENTS
CITY PROJECT NO. 010
WHEREAS, in 1992 after holding an assessment hearing the City Council
levied special assessments against the John B. Jordan property (PIN 18-
118-22-43-0001) for the benefit received from the Medina Road Improvement
Project; and
WHEREAS, the assessments were for immediate benefit that the property
received for the existing single family dwelling on the property and for
future benefit that the property would receive when it developed in
accordance with the City's Land Use Guide Plan; and
WHEREAS, John B. Jordan appealed the special assessment to the District
Court; and
WHEREAS, a proposed settlement has been mutually agreed to between the
City and Jordan which provides for immediate payment of the assessment
for the single family use of the property ($16,492.50) and deleting the
deferred assessment ($83,525.10) at this time for future benefit of the
property when it develops in accordance with the City's Land Use Plan.
The City does retain the right to determine any benefit that the property
received from the improvements when a future development is proposed.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the settlement agreement is approved and the
Mayor is authorized to sign the agreement on behalf of the City.
