RESOLUTION 93 - 755
APPROVING AMENDED MIXED PLANNED UNIT DEVELOPMENT
PREU IINARY PLAN/PLAT, AND CONDITIONAL USE PERMIT FOR
ROTTLUND HOMES, INC. FOR PROPERTY LOCATED ON THE EAST SIDE OF
SHENANDOAH LANE AT 22ND AVENUE NORTH (93055) (MPUD 83-1)
WHEREAS, Rottlund Hones, Inc. has re iuested approval for an Amended Mixed
Planned Unit Development Preliminary Plan/Plat, and Conditional Use Permit for 144
units to be known as Pintail Villas for property located on the east side of Shenandoah
Lane at 22nd Avenue North; and
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, 'FORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request of Rottlund Hones, Inc. for an Amended Mixed Planned Unit Development
Preliminary Plan/Plat, and Conditional Use Permit for a 144 units to be known as
Pintail Villas for property looted on the east side of Shenandoah I_.ane at 22nd Avenue
North, subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.
3. Submission of required financial guarantee and Site Performance Agreement for
completion of site improvements within 12 months of the date of this
Resolution.
4. Any signage shall be in compliance with the Ordinance.
5. Any subsequent phases or expansions are subject to required reviews and
approvals pre Ordinance provisions.
6. Compliance with the Ordinance regarding the location of fire hydrants and fire
lanes.
7. All waste and waste containers shall be stored within the buildings and no
outside storage is permitted.
8. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to
the release or reduction of any site improvement bonds per City Policy.
9. No building permit to be issued until the Final Plat is filed and recorded with
Hennepin County.

10. Development shall comply with all applicable requirements, Resolutions 84-14,
84-323, 87-176 and 87-337, and; the executed Development Contracts for
Parkers Lake Development - Stage B, Parkers Lake North.
11. Development shall comply with the approved Environmental Impact Statement
and related permits.
12. All Park Dedication requirements have been set aside with prior development
contracts for Parkers Lake North MPUD.
• 13. The Amended MPUD Preliminary Plan and Conditional Use Permit hereby
approved is for 144 dwelling units on this site.
14. The total numerical midpoints of the density in all areas must equal 1147 units.
If a Final Plat is developed above or below the midpoint of a density range
included in an approved PUD Preliminary Plat, then the density ranges in other
areas must be changed so that the density of the land platted plus the midpoint
of all areas, equals the maximum number allowed -- 1147 units. With each
application for residential plan/plat approval, the petitioner shall submit an
accounting of the number of units remaining, by the area, along with the
number of units that have been developed. Any reduction or increase in the
number of units from the established range, and a maximum number of units,
shall require an amendment to the Planned Unit Development. Similarly, each
Final Plat request shall include a status report stating the level of sanitary sewer
demand for all area developed to date, and the balance of capacity remaining in
this PUD.
15. The Homeowners Association document filed with this phase shall contain
provisions requiring construction by the association of up to 104 additional
"deferred" parking spaces shown in the "Proof -of -Parking" Plan and
Preliminary Plan upon the notification of the City of the need for additional off
street parking.
16. A variance from the standards of Plymouth City Code Section 550.21,
Subdivision 4 is approved with respect to each lot requiring frontage on a public
street based on the finding that this plat presents special circumstances and that
the variance will not be detrimental to other property.
17. The Final Plat shall refer to MPUD 83-1.
18. No fences or other building structures shall be located within the 25 foot front
yard setback along Shenandoah Lane or Ranchview Lane.
