RESOLUTION 93-754
APPROVING AMENDED RESIDENTIAL PLANNED UNIT DEVELOPMENT
PLAN AND CONDITIONAL USE PERMIT FOR HERITAGE WOODS ESTATES
FOR PROPERTY LOCATED EAST OF NORTHWEST BOULEVARD, WEST OF
PINBVILW LANE AND 58TH AVENUE NORTH (93110)
WHEREAS, Mike McMahon, on behalf of the property owners within the Heritage
Woods Estates Addition, has requested an Amended Planned Unit Development Plan
and Conditional Use Permit for property located East of Northwest Boulevard, West of
Pineview Lane and 58th Avenue North.
The property is more specifically described as:
Oudot A, and Lot 15 and Lot 16, Block 1, Heritage Woods Estates, Hennepin
County, Minnesota.
WHEREAS, the Planning Commission has reviewed said west at a duly called
Public Hearing and recommends approval;
NOW, TORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request of Mike McMahon on behalf of the property owners within the Heritage
Woods Estates Addition for an Amended Planned Unit Development Plan and
Conditional Use Permit for property located East of Northwest Boulevard, west of
Pineview Lane and 58th Avenue North, subject to the following conditions:
1. No other amendments of variances are granted or implied.
2. The PUD Amit is to eliminate the open space designated as Outlot A on
the Final Plat for Heritage Woods Estates. The amendment is based on the
following unique circumstances:
a. The Homeowners Association documents were not recorded in a timely
manner and several lots in the Subdivision were sold prior to the
recording of the documents.
b. The resulting Homeowners Association is not large enough to adequately
maintain the oudot.
C. A nearly unanimous request by the neighborhood has been submitted for
the elimination of the outlot.

3. Oudot A shall be divided between the adjacent property owners and shall not be
platted or recorded as a separate parcel and no building permits shall be issued
for a building to be constructed on the former Oudot A.
4. Maintenance responsibilities for the private trail between Rosewood Lane and
Northwest Boulevard shall be transferred to the City of Plymouth. The
Homeowners Association shall provide an easement to the City of Plymouth for
trail purposes.
5. No City funding shall be used for the removal of the existing tot lot on Oudot A
or in the costs involved in the division of Oudot A and consolidation with the
adjoining properties.
6. The City of Plymouth shall take action to eliminate the ponding of water on the
trail.
