HomeMy WebLinkAboutCity Council Resolution 1993-715CITY OF PLYMOUTH RESOLUTION 93 - 715 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF THE RELATED RPUD FINAL PLAT HARSTAD COMPANIES FOR "KINGSVIEW REGHTS 3RD ADDITION" FOR PROPERTY LOCATED WEST OF FERNBROOK LANE AT 42ND AVENUE NORTH (93098) WHEREAS, the City Council has approved the Final Plat for Harstad Companies for "Kingsview Heights 3rd Addition" located west of Fernbrook Lane and 42nd Avenue North; and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording of the Final Plat. 3. No building permits shall be issued until a contract has been awarded for the constriction of municipal sewer and water. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 6. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 7. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 8. Appropriate legal documents regarding Homeowner Association covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. 9. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 85-1, per Section 9 of the Zoning Ordinance. 10. Access shall be limited to internal public roads and prohibited from Fembrook Lane. • RESOLUTION NO. 93-715 File 93098, Page 2 11. Yard setbacks shall be a 30 foot front yard; 10 foot side yard and 25 foot rear yard setback. 12. The garage in Lot 1/Lot 2, Block 1 shall be removed from this subdivision prior to the issuance of building permits on Lot 1 or Lot 2, Block 1. 13. Prior to recording the plat, the developer shall verify that the owner of parcel of PIN 16-118-22-14-0007 has been informed of this development and has had the opportunity to discuss the status of parcel 16-118-22-18-0007 with the developer.
