HomeMy WebLinkAboutCity Council Resolution 1993-695CITY OF PLYMOUTH RESOLUTION 93- 695 APPROVING RESIDENTIAL PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN/PLAT AND CONDITIONAL USE PERMIT FOR NORTH SUBURBAN DEVELOPMENT, INC. LOCATED AT THE SOUTHWEST CORNER OF INTERSTATE HIGHWAY 494 AND COUNTY ROAD 47 (93035) WHEREAS, North Suburban Development, Inc. has requested approval of a Residential Planned Unit Development Preliminary Plan/Plat and Conditional Use Permit for the development of 62 single family detached lots on 29.57 acres located southwest of I-494 and County Road 47; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by North Suburban Development, Inc. for a Residential Planned Unit Development Preliminary Plan/Plat aviu Conditional Use Permit for property located southwest of I-494 and County Road 47, subject to the following findings and conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No building permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat and the dedication of Outlot B for park trail. 5. The deed for Outlot B shall be submitted to the City prior to recording the Final Plat. 6. Street names shall comply with the City Street Naming System. 7. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 8. Rezoning shall be finalized with the filing of the Final Plat. 9. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. Approved setbacks are: a. 35 foot front yard setback except for a 25 foot front yard setback is approved for Lots 30, 31, and 32, Block 3. b. 10 foot side yard setbacks. c. 15 foot rear yard setbacks. 11. Minimum lot size shall be 11,024 square feet. 12. Maximum lot coverage shall be 20 percent. 13. Private drive access shall be limited to internal public roads and restricted from County Road 47 and Interstate Highway 494. 14. Final Plat mylars shall refer to RPUD 93-1. 15. All wetland mitigation features recommended by the Wetland Analysis Report shall be referenced in the Development Contract and subject to financial guarantee for compliance. 16. Approval of the Department of Natural Resources for the area that is within the Shoreland Overlay District. 17. The monument sign shall meet all Zoning Ordinance requirements. 18. Approved minimum lot width shall be 85 feet. 19. Homeowners Association Documents shall be filed with this plat. The Documents shall include reference to maintenance of Outlot A. 20. Compliance with the agreement between North Suburban Development, Inc., Jerome P. Begin and Betty A. Begin and the City of Plymouth approved on October 18, 1993.
