RESOLUTION 93 -644
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF THE RELATED
MPUD FINAL PLAT FOR ORRIN THOMPSON HOMES FOR "PLYMOUTH
CREEK HEIGHTS" FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER
OF COUNTY ROAD 9 AND DUNKIRK LANE (92115)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Orrin Thompson Homes for "Plymouth Creek Heights" for property located at the
southeast comer of County Road 9 and Dunkirk Lane; and,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the following to be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. The ordinance rezoning the property shall be published upon evidence that the
Final Plat has been filed and recorded with Hennepin County.
3. Park dedication requirements shall be fulfilled by the dedication of park/trail
land (Outlots A, B, C and E)in combination with payment of park fees at the
time of Final Platting.
4. The developer shall construct a public trail in Oudot E per City standards.
Financial reimbursement for construction of trails will be determined at the time
of construction.
5. No building permits shall be issued until a contract has been awarded for the
construction of municipal sewer and water.
6. Removal of all dead or dying trees from the property at the owner's expense.
7. Removal of existing structures at the developer's expense.
8. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
9. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
10. No building permits to be issued until the Final Plat is filed and recorded with
Hennepin County.

11. Appropriate legal documents regarding Homeowner Association covenants and
restrictions, as approved by the City Attorney, shall be filed with the Final Plat.
12. The Final Plat mylars shall contain a statement noting that the plat is part of the
approved RPUD 92-7, per Section 9 of the Zoning Ordinance.
13. Access shall be limited to internal public roads and prohibited from Rockford
Road and Dunkirk Lane.
14. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
15. The minimum single family yard setback shall be 35 feet for the front yard; 10
feet and 10 feet for the side yard; and 25 feet for the rear yard.
16. Approved twinhome setbacks are:
a. 20 foot side setback to adjacent unit
b. 35 foot front setback to the right-of-way, except that a 30 foot front
setback may be approved on a case-by-case basis by staff to allow for
increased wetland and tree preservation.
C. 30 foot rear yard setback to adjacent units and 50 foot setback to the
Ordinary High Water Mark of Plymouth Creek.
17. Building permits shall not be issued for Lot 1, Block 14 until the temporary
access to Old Rockford Road is removed.
18. If building permits are issued for the units in Block 13 they shall be used only
for a model or sales office until the temporary access road to Old Rockford
Road is removed. After removal of the temporary access road, the continued
use of the lots for model/sales office shall be in accordance with the approving
resolution and city ordinances.
19. A combination of landscaping and berming shall be established along Rockford
Road.
20. Subsequent phases shall be subject to ordinance provisions for PUD Plan and
Plat applications for review and approval.
21. Blocks 1 through 13 are subject to Department of Natural Resources final
approval.
