RESOLUTION 93 - 605
APPROVING SITE PLAN, CONDMONAL USE PERMIT AND VARIANCES FOR
PRIME BUILDERS, INC. FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER
OF TRENTON LANE AND 44TH AVENUE NORTH (93091)
WHEREAS, Prime Builders, Inc. has requested a Site Plan, Conditional Use Permit and
Variances for a 36 unit townhouse development located at the southwest corner of Trenton
Lane and 44th Avenue North; and
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of
Prime Builders, Inc. for a Site Plan, Conditional Use Permit and Variances for a 36 unit
townhouse development located at the southwest corner of Trenton Lane and 44th Avenue
North; subject to the following conditions:
1. Compliance with the City Engineer's Memorandum.
2. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication
Policy in effect at the time of recording the Lot Consolidation with Hennepin County.
3. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.
4. Submission of required financial guarantee and Site Performance Agreement for
completion of site improvements within 12 months of the date of this resolution.
5. Any signage shall be in compliance with the Ordinance.
6. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
7. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes.
8. All waste and waste containers shall be stored within each unit, and no outside storage
is permitted.
9. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.

10. No building permit to be issued until the Lot Consolidation is filed and recorded with
Hennepin County.
11. A variance is granted for a 32 foot front yard setback and a 19 foot side yard setback.
12. A private drive system is approved for use in this "For Sale" multi -family project based
on the finding that the use of a public right-of-way would substantially reduce the
development potential of this site.
13. A variance is granted to allow for site coverage of 24 percent.
14. A Conditional Use Permit is issued for a 36 unit multi -family complex on this parcel.
15. A combination of landscaping and fencing screening shall be established along the
north property line in the vicinity adjacent to Lots 9, 10, and 11 of Woodlands
Addition.
