RESOLUTION 93 - 601
SETTING CONDITIONS TO BE MET PRIOR TO FILING OF THE RELATED
RESIDENT[AL FINAL PLAT FOR SCH 3RBER PARTNERSHIP, INC. "HOLLY
CREEK 2ND ADDITION" LOCATED WEST OF DUNKIRK LANE AT 41ST
AVENUE NORTH (93096)
WHEREAS, the City Council has approved the Final Plat and Development Contract
for Scheiber Partnership, Inc. for "Holly Creek 2nd Addition" located west of Dunkirk
Lane at 41st Avenue North; and,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the following to be met, prior to recording of, and related to said plat:
1. Compliance with the City Engineer's Memorandum.
2. Park dedication requirements shall include the dedication of Outlot B to the
City, and construction of the public trail. Any remaining park credit will be
carried forward to the third phase of Holly Creek.
3. No building permits shall be issued until a contract has been awarded for the
construction of municipal sewer and water.
4. Removal of all dead or dying trees from the property at the owner's expense.
5. Removal of existing structures at the developer's expense.
6. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for
new structures in subdivisions adjacent to, or containing any open storm water
drainage facility.
7. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
8. No building permits to be issued until the Final Plat is filed and recorded with
Hennepin County.
9. Appropriate legal documents regarding Homeowner Association covenants and
restrictions, as approved by the City Attorney, shall be filed with the Final Plat.
10. The Final Plat mylars shall contain a statement noting that the plat is part of the
approved RPUD 92-1, per Section 9 of the Zoning Ordinance.

11. Access shall be limited to internal public roads and prohibited from Dunkirk
Lane.
12. The Development Contract, as approved by the City Council, shall be fully
executed prior to release of the Final Plat.
13. Outlot B shall be deeded to the City prior to filing the Final Plat with Hennepin
County.
14. Minimum yard setbacks shall be 35 feet for front yards, 15 feet for side yards,
and 25 feet for mar yards.
15. Transitional screening and berming shall be provided along Dunkirk Lane.
