HomeMy WebLinkAboutCity Council Resolution 1993-523CITY OF PLYMOUTH RESOLUTION 93-523 APPROVING AMENDED RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT FOR LUNDGREN BROS. HEATHER RUN ADDITION (93081) WHEREAS, Lundgren Bros. has requested approval of an Amended Planned Unit Development Plan and Conditional Use Permit for an Alternative Signage and Fencing Plan for the Heather Run Addition; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Lundgren Bros. for an Amended Planned Unit Development Plan and Conditional Use Permit for an alternative Fencing and Signage Plan for Heather Run addition, subject to the following conditions: 1. No other amendments of variances are granted or implied. 2. All applicable requirements of the City and State Building Codes shall be implemented and enforced; no Code requirements are waived by this approval. 3, The Home Owners Association declaration of Covenants and Restrictions shall be amended as necessary and recorded with Hennepin County to provided for Home Owners Association maintenance of upkeep of the fencing, kiosks and landscaping and to include a hold harmless agreement to indemnify the City in legal issues related to the Kiosk in City right-of-way prior to issuance of the fence permits. 4. The approved Fencing and Signage Plan is shown on the plans dated "received August 13, 1993". 5. All kiosk, Fencing and landscaping materials within 20 feet of the street right- of-way comers shall be located and maintained so as not to impede safety by obstructing the vision of pedestrians or motor vehicle operators. Adopted by the City Council on September 13, 1993.
