HomeMy WebLinkAboutCity Council Resolution 1993-519CITY OF PLYMOUTH RESOLUTION 93 - 518 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF THE RELATED MPUD FINAL PLAT FOR HARSTAD HOMES, INC. FOR "SUGAR HMI S 2ND ADDITION" FOR PROPERTY LOCATED AT THE INTERSECTION OF 37TH AVENUE NORTH AND VICKSBURG LANE (93084) (MPUD 92-1) WHEREAS, the City Council has approved the Final Plat and Development Contract for Harstad Homes, Inc. for "Sugar Hills 2nd Addition" located at the intersection of 37th Avenue North and Vicksburg Lane; and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: 1. Compliance with the City Engineer's Memorandum. 2. The ordinance rezoning the property shall be published upon evidence that the Final Plat has been filed and recorded with Hennepin County. 3. Payment of park dedication fees -in -lieu of dedication with appropriate credits in an amount determined according to verified acreage and paving costs and according to the Dedication Policy in effect at the time of the filing of the Final Plat. No building permits shall be issued until a contract has been awarded for the construction of municipal sewer and water. 5. Removal of all dead or dying trees from the property at the owner's expense. Compliance of Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 8. No building permits to be issued until the Final Plat is filed and recorded with Hennepin County. 9. Appropriate legal documents regarding Homeowner Association covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. CITY OF -PLYMOUTH RESOLUTION 93 - 519 RELEASE OF SITE PERFORMANCE GUARANTEE FOR CROW- MINNETONKA/PLYMOUTH LIMITED PARTNERSHIP FOR PROPERTY LOCATED AT 13755 1ST AVENUE NORTH (88094) WHEREAS, a Site Plan for Crow-Minnetonka/Plymouth Limited Partnership was approved under City Council Resolution 88-548; and, WHEREAS, the developer submitted the required Site Performance Guarantee in the form of a Letter of Credit in the amount of $90,000 and, WHEREAS, the City Council by Resolution 89-618 reduced the Site Performance Guarantee to $7,000; and, WHEREAS, upon notice from the developer, City staff has inspected said site and recommends release of the financial guarantee; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does authorize the release of the Cash in the amount of $7,000, which was submitted to guarantee site improvements for Crow-Minnetonka/Plymouth Limited Partnership. Adopted by the City Council on September 13, 1993.
