FOR A MDC:D PLANNED UNIT DEVELOPMENT FOR "SUGAR HILIS 2ND ADDITION" LOCATED AT THE NORTHWEST INTERSECTION OF 37TH AVENUE NORTH AND VICKSBURG LANE (93084) (MPUD 92-1) WHEREAS, Harstad Homes, Inc. has requested a Final Plat for "Sugar Hills 2nd Addition" located at the northwest corner of 37th Avenue North and Vicksburg Lane; and, WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat and Development Contract for Harstad Homes, Inc. for "Sugar Hills 2nd Addition" located at the northwest corner of 37th Avenue North and Vicksburg Lane, and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City. The undersigned, being the duly qualified and appointed City Clerk of the City of Plymouth, Minnesota, certifies that I compared the foregoing resolution adopted at a meeting of the Plymouth City Council on , with the original thereof on file in my office, and the same is a correct transcription thereof. The Final Plat mylars shall contain a statement noting that the plat is part of the approved MPUD 92-1, per Section 9 of the Zoning Ordinance. 11. Access shall be limited to internal public roads and prohibited from County Road 9, Highway 55, Vicksburg Lane, 36th Avenue North and Dunkirk Lane. 12. The ownership of Lots 13, 14, and 15, Block 2, shall be retained by the developer until the curb and gutter have been constructed for County Road 9. 13. Building permits shall not be permitted for Lots 13, 14, and 15, Block 2, until curb and gutter for County Road 9 have been constructed. 14. A 50 foot woodland preservation easement shall be required on all single family lots adjacent to Vicksburg Lane and a 30 foot woodland preservation easement shall be required on all single family lots adjacent to the south side of County Road 9 as transitional screening. 15. Compliance with the terms of City Council Resolution 89-439 regarding tree preservation. 16. Dimensional standards for single family lots: a. The minimum side setback shall be 10 feet; the minimum rear setback shall be 20 feet; the minimum front yard setback shall be 35 feet for all internal streets and 36th Avenue North/Dunkirk Lane. b. The minimum lot width shall be 90 feet. 17. A 50 foot building setback is required for all buildings adjacent to County Road 9, and Vicksburg Lane right-of-way. 18. The Development Contract, as approved by the City Council, shall be fully executed prior to release of the Final Plat. Adopted by the City Council on September 13, 1993. (93084sc) •
