HomeMy WebLinkAboutCity Council Resolution 1993-505CITY OF PLYMOUTH RESOLUTION 93- 505 APPROVING PRELIMINARY PLAT AND VARIANCES FROM THE SUBDIVISION CODE AND THE ZONING ORDINANCE FOR DAHLSTROM COMPANIES, INC. LOCATED AT THE NORTHEAST QUADRANT OF ROCKFORD ROAD AND FERNBROOK LANE (93078) WHEREAS, Dahlstrom Companies, Inc. has requested approval for a Preliminary Plat and Variances for the Plymouth Oaks Subdivision, a plat for 41 lots and 4 outlots on 27.8 acres located in the northeast quadrant of Rockford Road and Fernbrook Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it hereby does approve the request by Dahlstrom Companies, Inc. for a Preliminary Plat and Variances for the Plymouth Oaks Subdivision, a plat for 41 lots and 3 outlots on 27.8 acres located in the northeast quadrant of Rockford Road and Fernbrook Lane, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No building permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of filing the Final Plat in combination with the dedication of Outlot D. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 8. Incorporation of tree protection provisions in the Final Plat and Development Contract approval. 9. A variance is granted for the creation of a 2.3 acre lot for a nonresidential use based on the finding that the reduced lot size will help preserve wetland areas. 10. Access from Lot 6, Block 6 to Dallas Lane North is prohibited. Res. 93-505, page 2 11. Access from Lot 1, Block 4 to County Road 9 is prohibited. The driveway shall be removed and connected to Cheshire Lane North. 12. Prior to recording the Final Plat, copies of the deeds for Outlots A -C and Lot 1, Block 4, Lot 4, Block 3, Lot 4, Block 2 shall be submitted to the City to ensure that the Outlots can be transferred to the lots if the Outlots are not incorporated into future developments. 13. The deed for Outlot D shall be submitted to the City prior to recording of the Final Plat. 14. Covenants shall be filed with the Final Plat on all lots in Block 1 and Block 2 placing the property owners on notice that Outlot D and the land east of the subdivision is Park property and that development of the park may include the construction of a parking lot and an interpretative center. 15. Covenants shall be filed with the Final Plat for Lot 9, Block 1 placing the property owner on notice that the 6 foot fence along the south property line shall be maintained by the owner of Lot 9, Block 1. 16. The developer shall construct a 6 foot wood fence in Lot 9, Block 1 to screen the property from Outlot D. 17. If the Park and Recreation Department determines that a parking lot is required for the park prior to December 31, 1994, the developer shall construct a 15 space parking lot. Park credit will be granted if construction is required. 18. Construction of Berkshire Lane in the City Park is the responsibility of the developer. Adopted by the City Council on August 30, 1993.
