RESOLUTION 93 - 501
DECLARING FINDING OF "NO NEED" FOR AN ENVIRONMENTAL IMPACT
STATEMENT (EIS) BASED UPON THE REVIEW OF THE ENVIRONMENTAL
ASSESSMENT WORKSHEET (EAW) DATED MAY, 1993 AND AMENDED
AUGUST, 1993 FOR THE PROJECT PROPOSED BY BATON CORPORATION
FOR "MISSION RIDGE" (92113)
WHEREAS, the City Council has reviewed an Environmental Assessment Worksheet
(SAW) for property known as "Mission Ridge" and the related PUD Preliminary
Plan/Plat, Conditional Use Permit and Subdivision Variance on August 30, 1993; and,
WHEREAS, pursuant to the Minnesota Environmental Quality Board (EQB) rule No.
4410.4300, Subpart 14b(3), the Environmental Review process, the City of Plymouth,
as a responsible government unit submitted an Environmental Assessment Worksheet
(EAW) for the development on May 24, 1993; and,
WHEREAS, it has been determined that the oroposed development does not present a
potential for environmental impacts of such significance that an Environmental Impact
Statement would be required;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does -make a
Negative Declaration on the Need for an Environmental Impact Statement (EIS) for the
proposed development known as "Mission Ridge" for Baton Corporation, subject to the
following conditions:
1. The proposed tennis court in Outlot A shall be eliminated.
2. Documentation regarding applicable Corp of Engineers Wetland Permits shall
be confirmed prior to RPUD Final Plan/Plat approval of this project.
3. A 10 foot wide deed restriction to create a buffer along the wetlands shall be
recorded to restrict private development next to the wetlands.
4. Deed restrictions shall be place on the rear of the single family lots to preserve
the forested arra including the understory growth.

5. A specific landscaping and management plan shall be submitted to provide for
additional habitat at the rear of the twin home units.
6. The applicant shall coordinate construction with the Department of Natural
Resources Area Wildlife Manager to retain habit value.
7. Deed restrictions shall be placed on the lots containing wetlands to restrict the
property owners from future filling or alterations of the wetlands.
8. A natural rip rap shall be used in lieu of the proposed keystone wall along the
.03 acres of Riverine Wetland proposed to be filled.
9. A 2 foot minimum vertical separation shall be required between the lowest floor
elevation of any building adjacent to ponding facility and the ponds 100 Year
Flood Elevation.
10. Strict adherence to the City's Erosion Control Policies shall be met. In
addition, the applicant shall work closely with Hennepin Parks in reviewing the
erosion and sediment plan for this site.
11. The proposed development shall include construction of onsite sedimentation
basins for storm water treatment consistent with Best Management Practices
guidelines.
12. Landscaping shall be installed between the twin home units and the DNR
wetland to help mitigate the visual impact of the twin homes from French
Regional Park. The applicant shall coordinate the planting with the DNR.
13. The proposal shall include the replanting of trees and shrubs along wetland areas
to mitigate the impact of the project on the views from the neighborhood and
Hennepin County French Regional Park. The developer shall work with
Department of Natural Resources as to the type and placement of plant materials
to be installed.
14. The length of the cul-de-sac should be reviewed to determine if a shorter cul-de-
sac
ul-do-sac would result in less environmental impacts while balancing the right of the
property owners to develop this site.
