RESOLUTION NO. 93497
REQUEST FOR PAYMENT NO. 2 AND FINAL
LARCH HEIGHTS LAc,OON OUTLET STRUCTURE
CITY PROJECT NO. 220
WHEREAS, the City of Plymouth as owner and Odesa Construction, Inc., as
contractor, have entered into an agreement for Larch Heights Lagoon Outlet
Structure, City Project No. 220, said agreement being dated March 8, 1993;
and
WHEREAS, the Engineer has certified acceptance of the work and approval of
the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $40,648.25. The
value of the work to date is $43,537.98 and is herewith
approved. This project overran the contract amount by
$2,889.73 or 7.1x.
2. That the work performed by the Contractor for Larch
Heights Lagoon Outlet Structure and certified to the
Council by the engineer as acceptable, being the same,
is hereby released from the contract except as to the
conditions of the performance bond, any and all legal
rights of the owner, required guarantees and correction
of faulty work after final payment.
3. Request for Payment No. 2 and Final in the amount of
$9,329.18 to Odesa Construction, Inc. for Larch Heights
Lagoon Outlet Structure is hereby approved and the City
Finance Director is hereby authorized and directed to
pay the same forthwith.
