RESOLUTION 93- 457
APPROVING CONDITIONAL USE PERMIT FOR QUANTUM DEVELOPMENT LOCATED AT 12325
STATE HIGHWAY 55 (93064)
WHEREAS, Quantum Development has requested a Conditional Use Permit for the
use of Beacon Heights gymnasium and storage space by ISD 284 (Wayzata Public
Schools) for property located at 12325 State Highway 55; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and recommends approval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Quantum Development for a Conditional Use Permit for the use of Beacon Heights
gymnasium and storage space by ISD 284 (Wayzata Public Schools) for property
located at 12325 State Highway 55, subject to the following conditions:
1. The permit is subject to all applicable codes, regulations and
Ordinances, and violation thereof shall be grounds for revocation.
2. The permit is issued to ISD 284 Wayzata as user of the gymnasium facility
and shall not be transferable.
3. The site shall be maintained in a sanitary manner.
4. There shall be no signage allowed on the property relative to the use.
5. Hours of operation shall be limited to 8:00 a.m. to 10:00 p.m., 7 days a
week.
6. A copy of the current State License shall be provided prior to issuance
of the permit and shall be kept on file with the City.
7. Compliance with applicable Building and Fire Code requirements shall be
verified by the City prior to permit issuance.
8. All parking shall be offstreet in designated areas which comply with the
Zoning Ordinance.
9. No Variances from any City Ordinances or Code Standards regarding this
use is granted or implied by this action.
10. This Conditional Use Permit is for the ISD 284 Independent School
District to use the gymnasium facility and storage area for recreational
services to the community.
