HomeMy WebLinkAboutCity Council Resolution 1993-370CITY OF PLYMOUTH RESOLUTION 93-370 APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR H.I. ENTERPRISES LOCATED AT THE SOUTHWEST CORNER OF HARBOR LANE AND EMPIRE LANE NORTH (93051) WHEREAS, H.I. Enterprises has requested approval of a Site Plan and Conditional Use Permit for a Goodyear Service Station for property located at the southwest corner of Harbor Lane and Empire Lane; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by H.I. Enterprises for a Site Plan and Conditional Use Permit for a Goodyear Service Station for property located at the southwest corner of Harbor Lane and Empire Lane, subject to the following conditions: 1. The permit is subject to all applicable codes, regulations and Ordinances, and violation thereof shall be grounds for revocation. • 2. The site shall be maintained in a sanitary manner. 3. All waste and waste containers shall be stored within approved designated area. 4. Any signage shall conform with the City Ordinance standards. 5. There shall be no outside display, sales, or storage of merchandise or related materials. 6. All parking shall be offstreet in designated areas which comply with the Zoning Ordinance. 7. The requested Conditional Use Permit for automobile service in the B-3 District is found to meet the standards set forth in the Zoning Ordinance. 8. Submission of the required financial guarantee for a Site Performance Agreement for completion of site improvements within 12 months. 9. Any subsequent phases or extensions are subject to required reviews and approvals per Ordinance provisions. 10. Payment of Park Dedication fees in lieu of dedication in accordance with the dedication policy in effect at the time of Building Permit issuance. 11. Compliance with the City Engineer's Memo. 12. Compliance with Policy 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage €ac;lity. RESOLUTION NO. 93-370 13. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes. 14. An S 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy.
