HomeMy WebLinkAboutCity Council Resolution 1993-320CITY OF PLYMOUTH RESOLUTION 93- 320 APPROVING AMENDED RESIDENTIAL PLANNED UNIT DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT FOR MR. AND MRS. JAMES KMIEC, LOCATED AT 5605 TEAKWOOD LANE NORTH (93043) WHEREAS, Mr. and Mrs. Kmiec have requested approval of an Amended Planned Unit Development Plan and Conditional Use Permit for property located at 5605 Teakwood Lane North to allow for a reduced side yard setback from 10 feet to 6 feet for the construction of a deck; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mr. and Mrs. Kmiec for an Amended Planned Unit Development Plan and Conditional Use Permit for property located at 5605 Teakwood Lane North, subject to the following conditions: 1. No other Amendments or Variances are granted or implied. 2. All applicable requirements of the City and State Building Code shall be implemented and enforced; no code requirements are waived by this approval. 3. The granting of the Permit is responsive to criteria of the Zoning Ordinance for Conditional Use Permits and PUD plans. 4. The deck shall be setback six feet from the side property line.
