HomeMy WebLinkAboutCity Council Resolution 1993-314CITY OF PLYMOUTH RESOLUTION NO. 93-313 AUTHORIZING THE VACATION OF OF A PORTION OF A DRAINAGE AND UTILITY EASEMENT IN LOT 6, BLOCK 4, SASS LAKE ESTATES ADDITION WHEREAS, a petition was received to vacate a portion of a drainage and utility easement in Lot 6, Block 4, Bass Lake Estates Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for June 7, 1993 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of June 7, 1993; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on June 7, 1993 to inform any and all interested parties relevant to the vacation of a portion of a drainage and utility easement in Lot 6, Block 4, Bass Lake Estates Addition; and WHEREAS, it was determined by the City Council that said easement is not needed for public purposes. NOW. THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following portion of a drainage and utility easement in Lot 6, Block 4. Bass Lake Estates Addition be vacated: That part of Lot 6, Block 4, Bass Lake Estates described as follows: Beginning at the point of intersection of a line drawn parallel with and 40.00 feet east of the west line of said Lot 6 with a line drawn parallel with and 40.00 feet southeasterly of the northwesterly line of said Lot 6; thence South 0 degrees 00 minutes 00 seconds East, assumed bearing, parallel with said west line 71.00 feet; thence North 90 degrees 00 minutes 00 seconds W 16.50 feet; thence North 0 degrees 00 minutes 00 seconds East 24.00 feet; thence North 19 degrees 20 minutes 40 seconds East 49.81 feet to the point of beginning. Adopted by the City Council on June 7, 1993 CITY OF PLYMOUTH RESOLUTION NO. 93-314 AUTHORIZING THE VACATION OF A PORTION OF SHENANDOAH LANE RIGHT OF WAY AND DRAINAGE AND UTILITY EASEMENTS ADJACENT TO OUTLOTS N AND R, PARKERS LAKE NORTH 2ND ADDITION WHEREAS, a petition was received to vacate a portion of Shenandoah Lane right-of-way and drainage and utility easements adjacent to Outlots N and R, Parkers Lake North 2nd Addition; and WHEREAS, a public hearing with respect to said vacation was scheduled for June 7, 1993 in accordance with Minnesota Statutes 412.851 as amended; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of June 7, 1993; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on June 7, 1993 to inform any and all interested parties relevant to the vacation of a portion of Shenandoah Lane right-of- way and drainage and utility easements adjacent to Outlots n. and R, Parkers Lake North 2nd Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacated: Description of Existing Centerline of Right -of -Way ("Line A")• Commencing at the Northwest corner of Outlot R, Parkers Lake North 2nd Addition; thence South 00 degrees 26 minutes 31 seconds East along the West line thereof a distance of 382.33 feet to the point of beginning of the line to be described; thence North 89 degrees 33 minutes 29 seconds East a distance of 52.22 feet to a point of curve; thence southeasterly along a tangential curve concave to the southwest having a radius of 537.89 feet, a central angle of 66 degrees 50 minutes 56 seconds, an arc length of 627.57 feet, and a chord which bears South 57 degrees 01 minutes 02 seconds East to the point of tangency and there terminating. Description of Proposed Centerline of Right -of -Way ("Line B")• Commencing at the Northwest corner of Outlot R, Parkers Lake North 2nd Addition; thence South 00 degrees 26 minutes 31 seconds East along the West line thereof a distance of 428.53 feet to the point of beginning of the line to be described; thence North 89 degrees 33 minutes 29 seconds East a distance of 122.22 feet to a point of curve; thence southeasterly along a tangential curve concave to the southwest having a radius of 461.76 feet, a central angle of 66 degrees 50 minutes 56 seconds, an arc length of 538.76 feet, and a chord which bears South 57 degrees 01 minutes 02 seconds East to the point of tangency and there terminating. • Resolution No. 93-314 Page Two vacation of Easement Descriptions: 1. The vacation of perpetual easement for public roadway purposes over, under, and across that part of the Right -of - Way of Shenandoah Lane that lies southerly of a line drawn parallel to and 38.0 feet northerly of Line A, and northerly of a line drawn parallel to and 38.0 feet northerly of Line B. Area - 14,154.49 S.F. 2. The vacation of perpetual easement for drainage and utility purposes over, under, and across that part of Outlot R, Parkers Lake North 2nd Addition that lies within 48.0 feet of Line A, and northerly of a line drawn parallel 'to and 48.0 feet northerly of Line B. Area - 5,336.74 S.F. 3. The vacation of perpetual easement for drainage and utility purposes over, under, and across the North 46.20 feet of the West 10.0 feet of Outlot N. Parkers Lake North 2nd Addition and also that part of said Outlot N that lies within 68.0 feet of Line A, and northerly of a line drawn parallel to and 58.0 feet southerly of Line B.
