RESOLUTION NO. 93-306
REQUEST FOR PAYMENT NO. 3 AND FINAL
NORTHWEST 17 SANITARY SEWER
CITY PROJECT NO. 040
WHEREAS, the City of Plymouth as owner and Ryan Contracting, Inc. as
contractor, have entered into an agreement for the Northwest 17 Sanitary
Sewer, City Project No. 040 said agreement being dated January 28, 1992;
and
WHEREAS, the Engineer has certified acceptance of the work and approval of
the final request for payment, including materials received by the City
for Phase II of the project.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $159,543.78, no
change orders were approved and the value of the work to
date is $131,473.45, including materials received by the
City for Phase II, and is herewith approved.
2. That the work performed by the Contractor for Northwest
17 Sanitary Sewer and certified to the Council by the
engineer as acceptable, being the same, is hereby
released from the contract except as to the conditions
of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work
after final payment.
3. Request for Payment No. 3 and Final in the amount of
$21,739.47 to Ryan Contracting, Inc. for Northwest 17
Sanitary Sewer is hereby approved and the City Finance
Director is hereby authorized and directed to pay the
same forthwith.
