HomeMy WebLinkAboutCity Council Resolution 1993-272CITY OF PLYMOUTH RESOLUTION 93-272 SETTING CONDITIONS TO BE MET PRIOR TO FILING OF AND RELATED TO RPUD FINAL PLAN/PLAT FOR NEDEGAARD CONSTRUCTION FOR COURTYARDS OF FRENCH CREEK LOCATED SOUTHWEST OF ROCKFORD ROAD AND LARCH LANE (93034) WHEREAS, the City Council has approved the Final Plat and Development Contract for Nedegaard Construction; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the following to be met, prior to recording of, and related to said plat: I. Compliance with the City Engineer's Memorandum. 2. Payment of park dedication fees -in -lieu of dedication in accordance with City Policy in effect at the time of filing the Final Plat. 3. No Building Permits shall be issued until a Contract has been awarded for the construction of municipal sewer and water. 4. Removal of all dead or dying trees from the property at the owner's expense. 5. Removal of existing structures at the developer's expense. 6. Compliance with Policy Resolution No. 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. 8. No Building Permits to be issued until the Final Plat is filed and recorded with Hennepin County. 9. Appropriate legal documents regarding Homeowner Association covenants and restrictions as approved by the City Attorney, shall be filed with the Final Plat. 10. The Final Plat mylars shall contain a statement noting that the plat is part of the approved RPUD 92-6 per Section 9 of the Zoning Ordinance. 11. Access shall be limited to internal public roads and prohibited from: Rockford Road (County Road 9). Resolution No. 93-272 Page Two, File 93034 12. The Development Contract as approved by the City Council shall be fully executed prior to release of the Final Plat. 13. Approved setbacks are: A. 10 foot side yard setback to living area, 6 foot side yard setback to the garage side, with a minimum 16 foot setback between structures. B. 35 foot front yard setback, 25 foot front yard setback to the garage; 35 foot front yard setback from County Road 9 to the garage; and a 15 foot front yard setback from County Road 9 to living area. C. 25 foot rear yard setback. 14. The minimum lot size shall be 7575 square feet. 15. Maximum lot coverage shall be 30 percent, except for 31 percent lot coverage is approved for Lots 1 through 5, Block 1. 16. Submission of a Site Improvement Performance Agreement for completion of private landscaping and amenities in the Courtyards of French Creek. 11. The RPUD Final Plan is hereby modified to show the reduction in the common open space from 0.46 acres to 0.16 acres; the relocation of one lot from the west perimeter of the site to the interior block; modification of the landscaping plan to include fencing in lieu of vegetation and elimination of any perimeter fencing along the south property line; and, the reduction of the number of private off street parking spaces from 37 to 12. 18. The RPUD Final Pian shall be modified so that all guest parking stalls will not be located in City right-of-way. Adopted by the City Council on May 17, 1993. (res/cc/93034.sc) 0 •
