HomeMy WebLinkAboutCity Council Resolution 1993-255CITY OF PLYMOUTH RESOLUTION 93-255 RESOLUTION OF INTERPRETATION OF THE PLYMOUTH HILLS PUD PLAN TO INCLUDE PUBLIC LIBRARIES AS A PERMITTED USE BETWEEN 36TH AVENUE NORTH AND 37TH AVENUE NORTH WHEREAS, the City Council has been requested to provide Resolution of Interpretation of the Zoning Ordinance and the Plymouth Hills PUD Plan regarding whether a Public Library is a Conditional Use or a Permitted Use in the area between 36th Avenue North and 37th Avenue North, and; WHEREAS, on September 14, 1992 the City Council approved an amendment to the Plymouth Hills PUD to allow any Conditional or Permitted B-1 or B-2 use in the area between 36th Avenue North and 37th Avenue North, with a number of stated exceptions; and, WHEREAS, governmental offices with or without merchandising services are permitted uses in the B-2 Zone. NOW THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that it should and hereby does make the following interpretations and findings regarding a public library at the northeast corner of Vicksburg Lane and 36th Avenue North: 1. A Public Library is found to be within the meaning of "governmental offices with (or without) merchandising services", as referenced in the Plymouth Zoning Ordinance. 2. The Plymouth Hills MPUD Plan, as amended September 14, 1992, does not list a public library as one of the excluded uses in the portion of the plan lying between 36th Avenue North and 37th Avenue North. 3. The public library is found to be a permitted use, not requiring a Conditional Use Permit, in the area of the Plymouth Hills PUD between 36th Avenue North and 37th Avenue North. Adopted by the City Council on May 17, 1993.
