HomeMy WebLinkAboutCity Council Resolution 1993-224CITY OF PLYMOUTH RESOLUTION 93-224 APPROVING PRELIMINARY PLAT FOR NEW CENTURY HOMES, INC. FOR KIMBERLY WOODS ADDITION LOCATED SOUTHWEST OF HOLLY LANE AND OLD ROCKFORD ROAD (93018) WHEREAS, New Century Homes Inc. has requested approval for a Preliminary Plat for Kimberly Woods Addition, a plat for six lots on 8.73 acres located southwest of Holly Lane and Old Rockford Road; and, WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it hereby does approve the request by New Century Homes, Inc. for a Preliminary Plat for Kimberly Woods Addition for six lots on 8.73 acres located southwest of Holly Lane and Old Rockford Road, subject to the following conditions: 1. Compliance with the City Engineer's Memorandum. 2. Removal of all dead or dying trees from the property at the owner's expense. 3. No building permits shall be issued until a contract has been awarded for sewer and water. 4. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in eftect at the time of filing the Final Plat. 5. Street names shall comply with the City Street Naming System. 6. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures in subdivisions adjacent to, or containing any open storm water drainage facility. 7. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. 8. Incorporation of tree protection provisions in the Final Plat and Development Contract. 9. A Zoning Ordinance Variance is hereby approved for a minimum lot area of 16,500 square feet for lots 1 through 4 based on compliance with the Zoning Ordinance Variance criteria. • RESOLUTION NO. 93-224 10. All setbacks shall meet the Zoning Ordinance standards for development in the R -1A Zoning District. 11. Approval by the City Council of the Wetlands Mitigation Plan submitted responsive to the Wetlands Act of 1991. Adopted by the City Council on May 3, 1993. res/cc/93018
